Welcome to BazarExa (“Company”, “we”, “our”, or “us”). These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “Customer”, “Seller”, or “You”) and BazarExa governing your access to and use of the BazarExa website (https://www.bazarexa.com), mobile-optimized versions, related software applications, and all associated services (collectively, the “Platform” or “Service”).

BazarExa operates as a dynamic multi-vendor e-commerce marketplace connecting independent sellers (“Merchants” / “Stores”) and buyers across Pakistan and eligible regions, offering lifestyle products, electronics, fashion, smartwatches, perfumes, footwear, accessories, and home goods.

2.1 Eligibility

You must be at least eighteen (18) years of age or the age of legal majority in your jurisdiction to create an account, purchase products, or register as a store owner on BazarExa. Individuals under 18 may only use the Service with the consent and direct supervision of a parent or legal guardian who agrees to be bound by these Terms.

2.2 Account Security & Responsibility

• You agree to provide accurate, complete, and current information during registration (including full name, valid email address, phone number, and delivery address).
• You are solely responsible for maintaining the confidentiality of your login credentials (passwords, OTPs) and for all activities that occur under your account.
• You must notify BazarExa customer support immediately at info@bazarexa.com upon suspecting any unauthorized access or breach of security.
• BazarExa reserves the right to suspend or terminate accounts that contain false, misleading, or fraudulent information.

BazarExa provides a platform for independent third-party merchants to establish online stores, list products, and fulfill customer orders, in addition to products managed directly by BazarExa.

4.1 Pricing & Accuracy

All prices listed on the Platform are in Pakistani Rupees (PKR) and are inclusive of applicable sales taxes unless explicitly stated otherwise. Delivery fees are calculated and shown transparently during the checkout process before payment confirmation.

4.2 Errors and Modifications

While we make every effort to ensure accurate pricing, imagery, and specifications, inadvertent errors may occur. BazarExa and its sellers reserve the right to correct pricing errors, modify product descriptions, or cancel orders placed for products listed with typographical or pricing inaccuracies prior to dispatch.

4.3 Flash Sales & Promotions

Promotional offers, flash sale discounts, coupons, and free delivery perks are subject to specific terms, stock limitations, and timeframes. BazarExa reserves the right to modify or terminate promotional campaigns at any time without prior liability.

5.1 Order Acceptance

Your submission of an order represents an offer to purchase the specified items. Order receipt emails or SMS notifications acknowledge your request but do not signify final acceptance. A binding contract is finalized once your order has been confirmed and dispatched by the merchant or logistics provider.

5.2 Payment Methods

BazarExa offers versatile and secure payment channels:

• Cash on Delivery (COD): Pay cash directly to the courier partner upon receipt of your parcel. Please prepare the exact invoice amount.
• Credit / Debit Cards: Processed through secure, PCI-DSS compliant payment gateways with encryption protection.
• Digital Wallets & Bank Transfers: Supported local bank transfers and mobile wallets (JazzCash, EasyPaisa, etc.) where applicable.

BazarExa does not store full debit/credit card numbers or sensitive CVV codes on our servers. All transactions are routed through verified third-party banking gateways.

6.1 Delivery Timeframes

Standard delivery within major cities in Pakistan (Karachi, Lahore, Islamabad, Rawalpindi, Faisalabad, Peshawar, etc.) typically takes 2 to 5 business days. Remote or regional areas may take 4 to 8 business days. Estimated delivery dates are indicative and may vary due to unforeseen logistics, severe weather, or public holidays.

6.2 Risk of Loss & Inspection at Delivery

The risk of loss and title for products pass to you upon delivery by the courier service. Customers are strongly encouraged to inspect external packaging for tampering or severe physical damage before signing the delivery receipt.

7.1 Order Cancellation

You may cancel an order free of charge at any time before the seller has processed and handed over the parcel to the logistics partner. Once dispatched, cancellations are handled under our Return Policy.

7.2 5-Day Return Window & Mandatory Unboxing Video

BazarExa offers a 5-day return window from the date of parcel receipt. For customer protection and swift verification, providing an uncut, continuous unboxing video recorded prior to opening the package seals is strictly mandatory for all return and refund claims. 7.3 Non-Returnable Items

For health, hygienic, and security reasons, the following categories are non-returnable unless received damaged or incorrect with valid unboxing video proof: innerwear/lingerie, cosmetics/skincare products with broken security seals, opened perfume bottles, unsealed software/digital items, and personalized/custom goods.

7.4 Refund Processing

Once the returned item is received and inspected at our quality assurance facility, approved refunds are disbursed within 2 to 4 working days for bank/wallet transfers and 5 to 10 working days for debit/credit cards according to customer preference.

Users who register a digital storefront via our Sell on BazarExa portal agree to adhere to strict merchant standards:

• Product Authenticity: Merchants shall only sell genuine, authentic, brand-compliant products. Counterfeit goods, unauthorized replicas, and stolen merchandise are strictly banned and result in immediate store termination and legal referral.
• Fulfillment Timelines: Sellers must process and dispatch orders within designated fulfillment windows (typically 24-48 hours).
• Accurate Inventory: Store owners must maintain up-to-date pricing, stock levels, and truthful descriptions without deceptive imagery.
• Commission & Payouts: BazarExa deducts agreed marketplace commission fees from sales proceeds prior to initiating scheduled seller payouts.

BazarExa integrates artificial intelligence (AI) and automated algorithmic recommendations to assist shoppers in discovering products, comparing specifications, and answering queries.

You agree that you will not use the Service for any unlawful or unauthorized purpose. Specifically, you agree NOT to:

• Violate any local, provincial, national, or international law, statute, or regulation in Pakistan or abroad.
• Post false, fake, misleading reviews, fraudulent ratings, or spam other community members.
• Deploy automated spiders, web scrapers, bots, or extraction scripts to harvest data from BazarExa without explicit written authorization.
• Circumvent security controls, introduce viruses, trojans, ransomware, or disrupt network infrastructure.
• Harass, threaten, or abuse customer support personnel, couriers, or other platform members.

All platform software, graphics, logos, trademarks, page layouts, UI/UX elements, icons, text, and digital assets associated with BazarExa are the exclusive property of BazarExa and its licensors, protected under Pakistani copyright, trademark, and intellectual property laws.

Users may not copy, reproduce, duplicate, sell, or exploit any portion of BazarExa without express written permission from our management.

“AS IS” and “AS AVAILABLE”

The BazarExa Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied. To the maximum extent permitted by applicable law in Pakistan, BazarExa disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

In no event shall BazarExa, its directors, officers, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your access to, use of, or inability to use the Platform. In all cases, BazarExa’s aggregate liability shall not exceed the total amount paid by you for the specific order giving rise to the claim.

These Terms and Conditions and any separate agreements shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan.

In the event of any dispute, claim, or disagreement, the parties shall first make good-faith efforts to settle the matter amicably through our dedicated Dispute Resolution Support team. If unresolved within thirty (30) days, the dispute shall be subject to the exclusive jurisdiction of the competent courts in Pakistan.

We reserve the right to revise, modify, or update these Terms and Conditions at any time to reflect operational, legal, or regulatory adjustments. When changes occur, we will update the “Last Updated” date at the top of this document. Continued use of BazarExa following the posting of modifications indicates your binding acceptance of the updated Terms.
